After a French Court found Easyjet guilty of discriminating against disabled passengers in two separate cases in 2008 and 2009 earlier this month, resultant discussions within the European Commission have forced new debates with regards to Regulation 1107/2006. This piece of legislation was brought in by the European Commission mobility and transport which aimed to bring about equal rights for persons with reduced mobility and adequate wheelchair accessible vehicles , responding particularly to air travel.

Under this regulation, airport managing bodies are supposed to be responsible for disabled assistance on the ground, but these recent evasions of the policy by Easyjet have forced the European Commission to draft “Interpretative Guidelines on the application of Regulation 1107/2006” in order to establish who should be considered to have a disability.

Although this has certainly been a landmark case, and one that is set to put renewed pressure on travel companies and airlines, Mobility and Transport Officer of the European Disability Forum (EDF), Guillaume Dufresne believes that it could cause “operational difficulties” he goes on to say:

“The goal of interpretation guidelines is to improve the journey for 80 million Europeans with disabilities and the European institutions should keep focus on this objective.”

Since the introduction of the regulation, airports in Europe have reported consistent growth in requests for assistance from persons with reduced mobility and the new guidelines are being introduced to help define what constitutes a PRM. This in itself is controversial however, as some establishments believe that this will lead to abuse of the system. ACI EUROPE have hit out at the new proposals stating that it will lead to abuse of the system by people asking to be facilitated who would previously have been able to navigate the airport on their own. It is believed that in turn, this will lead to a decline in standards of service for those who are really in need and increased costs for the provider.
